GENERAL AGREEMENT

Craffox provides the content and services available on www.craffox.com, hereinafter referred to as Site to you subject to the following terms and conditions, our Delivery Policy, Returns Policy and other terms and conditions and policies which you may find throughout our Site in connection with certain functionality, features or promotions as well as customer service, all of which are deemed a part of and included within these terms and conditions (collectively - Terms and Conditions). By accessing or using the Site, you are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms and Conditions. Where the customer purchases items offered for sale on Site www.craffox.com, hereinafter referred to as Goods, via the Internet, this mutual agreement shall be deemed a Distance Contract and will  be subject to legal norms governing distance contracts, including but not limited to Directive No. 97/7/EEC of the European Parliament and of the Councilon the protection of consumers in respect of distance contracts, Consumer Rights Protection Law of the Republic of Latvia, Cabinet Regulation of the Republic of Latvian on Distance Contracts.

LIMITATION OF LIABILITY

    You agree that, fully according to applicable law, Craffox will not be responsible or liable (whether in contract, negligence or otherwise), under any circumstances, for any interruption or error occurring from your use of the Site.

You agree that, fully according to applicable law, Craffox will not be responsible or liable (whether in contract, tort (including negligence) or otherwise), under any circumstances, for any (a) interruption of business; (b) access delays or access interruptions to the Site; (c) data non-delivery, misdelivery, corruption, destruction or other modification; (d) loss or damages of any sort incurred as a result of dealings with or the presence of off-website links on the site; (e) computer viruses, system failures or malfunctions which may occur in connection with your use of the site, including during hyperlink to or from third party websites (f) any inaccuracies or omissions in content or (g) events beyond our reasonable control.

Craffox will not be liable for any indirect, special, incidental, or consequential damages of any kind (including lost profits) related to the Site or your use thereof (or inability to use the site) regardless of the form of action whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages.

 

PAYMENT

     All products remain Craffox’s property until full payment is made. The price applicable is that set at the date on which you place your order. Shipping costs and payment fees are recognized before confirming the purchase. If you are under 18 years old you must have parents’ permission to buy from Craffox.
   All transfers conducted through Craffox are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway choosen for the transaction as they are responsible for the transactions made.

 

LOCAL TAXES

    Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customers own expense.

RETURN POLICY

     Please contact Craffox before returning any items.

    Returns of ordered and delivered orders are handled on case by case basis following simple procedures. We ask you to review our Returns policy to make sure you are aware of the options you have for product return and receive information and conditions of cancellation of the contract.

    It is appropriate that the consumer controls the delivery to verify that this is accurate and error free. At the complaint, the customer contacts Craffox and gives information relevant and the reason for complaint. You can return the product within 14 days of delivery. The product must be in new condition. If the product is ruined or used the product shall not be refunded. Make sure to include contact information with the return and if possible, please provide us with a tracking number. Craffox suggests you get a receipt and a package ID for the return from the delivery service, as it makes it easier to follow the return shipment if needed. The customer covers return shipping cost.
    Craffox will make a refund of eligible returns. If you paid by invoice, we will need a bank account number to transfer the money back to. The money transfer back is possible when we receive returned goods and check condition of goods. The easiest way is to e-mail it to us along with a brief description of your case. 

If a returned item is shipped international, please clearly mark the package 'RETURNED GOODS', to avoid any Customs charges.       Craffox is NOT responsible for any return Customs charges made. Any charges incurred are the responsibility of the customer. 

In case if you want to switch to another color of the same product e-mail us, provide your customer information, and tell us you will send back the product and the colour you wish to receive in exchange.

    If the product is lost or you, upon receiving, notice that the item has been damaged during transport, you should immediately report this to us.

COOKIES

    Craffox uses cookies according to the new Electronic Communications Act, which came into force on 25 July 2003. A cookie is a small text file stored on your computer that contains information that helps the Site to identify  and track the visitor. Cookies do no harm to your computer, consist only of text, can not contain viruses and occupies virtually no space on your hard drive. There are two types of cookies: “Session Cookies” and cookies that are saved permanently on your computer.
    The first type of cookie commonly used is “Session Cookies”. During the time you visit the Site, our web server assigns your browser a unique identifier string so as not to confuse you with other visitors. A “Session Cookie” is never stored permanently on your computer and disappears when you close your browser. To use Craffox without troubles you need to have cookies enabled. The second type of cookie saves a file permanently on your computer. This type of cookie is used to track how visitors move around on the Site. This is only used to offer visitors better services and support. The text files can be deleted. On Craffox we use this type of cookie to keep track of your shopping cart and to keep statistics of our visitors. The information  stored on your computer is only a unique number, without any connection to personal information.

PERSONAL INFORMATION

    All personal information you provide us with or that we obtain will be handled by Craffox as responsible for the personal information. The personal information you provide will be used to ensure deliveries to you, the credit assessment, to provide offers and information on our catalog to you. The information you provide is only available to Craffox and will not be shared with other third parties. You have the right to inspect the information held about you. You always have the right to request Craffox to delete or correct the information held about you. By accepting the Craffox Conditions, you agree to the above.

FORCE MAJEURE

    Craffox shall not be held responsible for any delays, failures to fulfil obligation or any other failures that occurred due to circumstances and obstacles that are beyond our reasonable control, which include but are not limited to strikes, governmental actions, wars or national emergencies, terrorism threats or acts of terrorism, environmental or climatic anomalies, failure of performance by a third party, internet connection issues as well as hardware and software malfunction. In the event that any such force majeure occurs we will try to eliminate the delays in the shortest time possible.

ADDITIONAL INFORMATION

   Craffox reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. At the event of when a product is sold out, Craffox has the right to cancel the order and refund any amount paid in the best way. Craffox shall also notify the customer of equivalent replacement products if available.

 

APPLICALBLE LAW AND PLACE OF JURISDICTION

    The most recent version of the Terms and Conditions is stored on the Craffox website and is available to be viewed by anyone. The same applies to earlier versions of the Terms and Conditions. 
Craffox is entitled, for the purpose of performing its obligations under this agreement, to also avail itself of third parties as so-called vicarious agents. 
    Claims against Craffox may not be assigned to third parties either in part or in full. 
The legal relationship between the parties to this agreement is subject to Latvian law. Cesis shall be the sole place of jurisdiction in respect of business persons, legal persons incorporated under public law or special funds under public law. In addition, Cesis shall be the sole place of jurisdiction in respect of entrepreneurs if the member has no general place of jurisdiction in Latvia or the member moves his domicile or main residence out of Latvia after the conclusion of the agreement or if the domicile or main residence of the member is unknown.
